Connecticut was the first state in the country to enact a new automobile warranty law, more commonly known as the "Lemon Law." The Connecticut Lemon Law applies to motor vehicles with substantial defects occurring within 24 months or 24,000 miles. Although the Lemon Law does not apply to used cars, Other consumer protection laws may apply to defects that occur in older cars.
The Lemon Law reuqires manufacturers to repurchase or replace a vehicle if it is not able to repair a defect after having been given a resonable opportunity (usually four repair attempts) to do so. If the manufacturer refuses to either repurchase or replace the vehicle, then the consumer can either bring a suit against the manufacturer or bring a claim before the Connecticut Department of Consumer Protection's Lemon Law Program.
A consumer who successfully pursues a claim is entitled to recover attorney's fees from the manufacturer and may also be awarded punitive damages. Although the state's arbitration program is designed so that a consumer can bring a claim without an attorney, many manufacturers are represented by legal counsel, and many consumers prefer to be represented as well.
Consumer Law Group assists many consumers with lemon law claims. We charge $300 for a consultation. As part of our review, we will:
Evaluate all paperwork for compliance with Connecticut and federal consumer protection and finance disclosure laws in order to determine whether any auto dealer fraud issues exist.
Review the claimed defects and evaluate the existence and strength of any lemon law or other auto warranty claims.
Advise the client regarding options and recommended strategies.
Provide guidance and assistance to consumers who decide to pursue claims on their own.
Represent consumers who elect to proceed with counsel (additional fees may apply).
Although many consumers are able to successfully pursue lemon law claims without any assistance, we find that most consumers will benefit from spending some time with a lawyer who can assist them in presenting their claim and making sure that they are claiming all of the damages to which they may be entitled.
